for Tickets, Vouchers and Memberships
1. Scope of application
1.1 These General Terms and Conditions (‘GTC’) govern the contractual relationship between Beyeler Museum AG, Baselstrasse 101, 4125 Riehen (‘Fondation Beyeler’) and its customers (‘Customers’) regarding the purchase and use of:
a) Museum admission tickets
b) Tickets for public tours, bookings of private group tours and activities for school groups
c) Tickets for events (‘Event Tickets’)
d) Vouchers
e) Memberships (Art Club; Young Art Club; Friends of Fondation Beyeler; Patronesses; BEYS) (‘Membership(s)’)
Museum admission tickets and Event Tickets are hereinafter also referred to collectively as ‘Tickets’.
1.2 The following shall apply to the contractual relationship in the order listed below: (i) Any special terms and conditions for the offer in question expressly indicated as such in the booking, invitation or payment request; (ii) the booking, order or payment confirmation; (iii) these GTC.
1.3 Visitors to the Fondation Beyeler must also comply with the current house rules.
1.4 In the case of Memberships that are offered by invitation only, reference shall be made to these GTC in the invitation or payment request and the Customer shall be given the opportunity to read them before concluding the contract. By accepting the invitation or the offer, the Customer agrees to these GTC.
2. Conclusion of contract
2.1 The listing of Tickets, vouchers, Memberships and other offers in the online shop constitutes an invitation to place an order.
2.2 When placing orders in the online shop, Customers submit a binding order upon completion of the ordering process. The contract comes into effect upon confirmation of the order by Fondation Beyeler.
2.3 In the case of Memberships that are offered by invitation only, the contract comes into effect upon acceptance of the individual invitation or offer, at the latest upon payment of the Membership fee indicated therein, unless otherwise specified in the invitation.
2.4 Customers are responsible for checking the accuracy of the information provided in the context of the order or registration. Obvious errors in a confirmation must be reported to Fondation Beyeler without delay.
2.5 In the event of obvious errors in pricing, spelling, calculations or the system, Fondation Beyeler is not obliged to provide the service under the incorrectly stated terms. Any payments that have already been made will be refunded.
3. Prices and payment
3.1 The prices or fees in Swiss francs (CHF) stated at the time of conclusion of the contract in the relevant sales channel or in the individual invitation or payment request shall apply, including any statutory VAT, where applicable.
3.2 Fondation Beyeler may change prices and Membership fees for future contracts at any time. Contracts that have already been concluded shall remain unaffected.
3.3 The available payment methods will be displayed in the order process or in the individual payment request.
3.4 The price or Membership fee is due for payment upon conclusion of the contract, unless otherwise agreed.
4. Tickets
4.1 Once the order has been placed successfully, e-tickets will be made available for download and sent to the email address provided by the Customer.
4.2 A Ticket entitles the holder to admission or participation exclusively to the extent specified on it, in particular with regard to the date, time slot, event and Ticket category.
4.3 Tickets may not be duplicated or misused. Where multiple Tickets are presented, only the first Ticket to be checked grants admission.
4.4 If there are concrete indications of misuse, Fondation Beyeler may block the Ticket in question or refuse admission.
4.5 Concessionary Tickets or Tickets subject to personal eligibility criteria are only valid when accompanied by the necessary proof. If this is not presented, Fondation Beyeler may charge the difference from the regular Ticket price or refuse admission.
4.6 Readmission on the same day is possible following consultation with the museum staff.
4.7 Lost or stolen Tickets will not be replaced.
5. Changes to museum operations and force majeure
5.1 Fondation Beyeler may change opening hours, restrict access to the museum or individual areas, and temporarily block access to individual works, rooms or services if this is necessary for operational, organisational, conservation, security-related or similar objective reasons.
5.2 The same applies to circumstances beyond the reasonable sphere of influence of Fondation Beyeler, in particular natural disasters, epidemics, official orders, strikes, technical faults or similar events (‘Force Majeure’).
5.3 Changes to individual works on display, temporary closure of individual rooms or similar restrictions do not entitle the Customer to a refund or a reduction in price, provided that the essential nature of the booked service remains unchanged.
5.4 If a booked service cannot be provided in full, Fondation Beyeler may offer an alternative date, a credit note or an equivalent alternative service. If an appropriate replacement service is not possible or cannot be reasonably expected of the Customer, the price paid for the service not provided will be refunded.
6. Liability
6.1 Fondation Beyeler is liable for any damage it has caused intentionally or through gross negligence. To the extent permitted by law, Fondation Beyeler accepts no liability for slight negligence, auxiliaries, indirect damage or consequential damage (such as loss of profit).
6.2 Fondation Beyeler shall not be liable for disruptions to performance due to Force Majeure or other circumstances beyond its reasonable sphere of influence.
6.3 Fondation Beyeler is only liable for loss, theft or damage to personal belongings within the scope of the statutory provisions.
6.4 The right to apply mandatory statutory liability provisions is reserved.
7. Data protection
The processing of personal data by Fondation Beyeler is based on the applicable data protection law and Fondation Beyeler’s current privacy policy.
8. User accounts
8.1 Customers are obliged to provide complete and correct information when setting up and using a user account and to protect their login details from access by third parties.
8.2 In the event of misuse, security risks or significant violations of these GTC, Fondation Beyeler may block a user account. In the event of serious or repeated violations, the user account may be deleted.
9. Museum admission tickets
9.1 Validity
Museum admission tickets are valid for the date indicated on them and, if applicable, for the time slot booked.
9.2 Cancellation
9.2.1 Customers may only cancel a booking if the Ticket in question expressly provides for the option to do so.
9.2.2 Unless otherwise stated, it is only possible to cancel the entire order and not an individual Ticket within an order.
9.2.3 In the event of a valid cancellation, the Customer will receive a cancellation credit note for the amount cancelled. The cancellation credit note cannot be paid out or refunded.
9.2.4 Cancellation credit notes can be redeemed for Ticket purchases in the online ticket shop or at the museum ticket office and are valid for one year from the date of issue.
10. Public and private tours and school groups
10.1 General information
10.1.1 Tickets or bookings for public tours, private group tours and school groups can be purchased or made via the booking channels offered by Fondation Beyeler.
10.1.2 External art educators and tour guides may not conduct their own tours of the museum without the prior consent of Fondation Beyeler.
10.1.3 A reduction in the number of participants will not be considered a cancellation and will not lead to a reduction in the agreed price.
10.2 Public tours
Paragraph 9.2 applies to the cancellation of Tickets for public tours.
10.3 Private group tours
10.3.1 Cancellations of private group tours must be made in writing. The date of receipt by Fondation Beyeler shall be decisive.
10.3.2 Unless otherwise agreed at the time of booking, the following cancellation conditions apply:
a) Up to 30 days before the date: free of charge
b) 29 to 14 days before the date: CHF 256 or the agreed price, whichever is lower
c) 13 to five days before the date: CHF 500 or the agreed price, whichever is lower
d) Less than five days before the date or in the event of no-show: the full agreed price
10.4 School groups
10.4.1 Cancellations of tours for school groups must be made in writing no later than seven days before the agreed date.
10.4.2 In the event of a later cancellation, Fondation Beyeler may charge a fee of CHF 100 per group.
10.5 Late arrival
In the event of late arrival, there is no entitlement to an extension of the booked tour duration or a reduction in the agreed price.
11. Events
11.1 Event Tickets
11.1.1 Event Tickets entitle the holder to attend the designated event.
11.1.2 Insofar as this is expressly stated for the respective event, the Event Ticket also includes admission to the museum on the day of the event.
11.1.3 Specific terms and conditions may apply to individual events. These will be announced at the time of booking.
11.2 Cancellation by the Customer
Paragraph 9.2 applies to cancellations by Customers, unless otherwise stated for the event in question.
11.3 Cancellation by Fondation Beyeler
If an event is cancelled by Fondation Beyeler without replacement, the price paid will be refunded.
11.4 Postponement
11.4.1 In the event of a postponement, the Event Ticket shall remain valid for the alternative date.
11.4.2 If the Customer is unable to attend the alternative date, they may request a refund of the Ticket price within the timeframe specified by Fondation Beyeler.
12. Vouchers
12.1 Vouchers can be purchased in the online shop and at the Fondation Beyeler museum ticket office. The value of the voucher corresponds to the amount shown at the time of purchase.
12.2 Vouchers can be redeemed for Ticket purchases via the online ticket shop or at the museum ticket office. They cannot be redeemed in the Art Shop or the restaurant.
12.3 To the extent permitted by law, the voucher value cannot be paid out or refunded.
12.4 Purchased vouchers are valid for 10 years from the date of issue.
13. Memberships
13.1 General information
13.1.1 Memberships are personal schemes run by Fondation Beyeler. They do not constitute membership under association or company law.
13.1.2 Unless otherwise specified for a particular Membership, Membership is open to anyone aged 18 and over.
13.1.3 Memberships and the associated benefits are personal and non-transferable. Depending on the Membership, a digital or physical Membership card will be issued. Fondation Beyeler may request proof of identity when the card is used.
13.1.4 Membership is generally valid for one year from the start date indicated at the time of purchase or in the invitation. Unless expressly agreed otherwise at the time of purchase or in the invitation, Membership will not be automatically renewed.
13.2 Benefits
13.2.1 Memberships entitle the holder to the benefits stated at the time of conclusion of the contract for the respective Membership or as set out in the individual invitation or payment request.
13.2.2 Prior registration and limited capacities may apply to events and other offers. Memberships do not entitle members to attend a specific event if said event is fully booked.
13.3 Changes
Fondation Beyeler may modify, replace or discontinue the benefits of Membership at any time, in particular for practical, operational, organisational or programme-related reasons. Furthermore, Fondation Beyeler reserves the right to make any changes that are strictly necessary for legal, official or security reasons.
13.4 Cancellation and early termination
13.4.1 Following conclusion of the contract, a Membership cannot be cancelled or terminated prematurely by the member.
13.4.2 In the event of non-use or premature termination of a Membership, there is no entitlement to a full or partial refund of the Membership price. Mandatory statutory entitlements remain reserved.
13.5 Misuse
13.5.1 In the event of misuse of a Membership or a Membership card, Fondation Beyeler may temporarily suspend the Membership.
13.5.2 In the event of serious or repeated misuse, Fondation Beyeler may terminate the Membership with immediate effect following prior warning. A warning is not required if it would be unreasonable to allow the Membership to continue given the seriousness of the violation.
13.5.3 In the event of a justified termination due to serious misuse, there is no entitlement to a refund of the Membership fee.
13.6 Art Club Membership
13.6.1 Art Club Membership is offered as Individual Membership, Partner Membership or Flexi Membership.
13.6.2 Individual Membership is issued to a named individual and entitles only this person to use the services associated with the Membership.
13.6.3 Partner Membership is issued to two named individuals and entitles only these two people to use the services associated with the Membership.
13.6.4 In the case of Flexi Membership, the Membership is issued to a named principal member. The principal member receives a digital Membership card, which entitles the principal member and an accompanying person of their choice entry to the museum at the same time. The accompanying person may be chosen freely on each visit. The digital Membership card must not be used without the principal member.
13.7 Young Art Club Membership
13.7.1 Young Art Club Membership is open to anyone aged 18 to 35.
13.7.2 Eligibility and the relevant price category are determined by the member’s age at the start of their Membership. Fondation Beyeler may request proof of age and identity.
13.7.3 Reaching a higher age category or the age limit during the current Membership will not affect its validity or price.
13.8 ‘Friends of Fondation Beyeler’ Membership
13.8.1 The ‘Friends of Fondation Beyeler’ Membership is offered exclusively by invitation from the management.
13.8.2 The respective Membership fee is based on the applicable age category at the beginning of the Membership and is specified in the individual invitation or payment request.
13.9 ‘Patronesses’ Membership
‘Patronesses’ Membership is open only to women and is offered only by invitation from the management.
13.10 ‘BEYS’ Membership
‘BEYS’ Membership is offered only by invitation from the management.
14. Other provisions
14.1 These GTC and the applicable special conditions in accordance with Paragraph 1.2 conclusively govern the contractual relationship between Fondation Beyeler and the Customer with regard to the respective subject matter of the contract.
14.2 Fondation Beyeler may amend these GTC at any time. Changes apply to contracts concluded after the amended GTC come into force. For contracts that have already been concluded, the version agreed upon at the time the contract was concluded shall apply. Fondation Beyeler reserves the right to make changes due to mandatory legal or official requirements.
14.3 Should any provision of these GTC be invalid or unenforceable in whole or in part, this shall not affect the validity of the remaining provisions.
14.4 Swiss law shall apply to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).
14.5 The courts of Basel-Stadt shall have exclusive jurisdiction over all disputes arising from or in connection with the contractual relationship, provided that no mandatory statutory rules on jurisdiction preclude this.
