1. Scope of Application
1.1. These General Terms and Conditions, in the version valid at the time of conclusion of the contract, apply to all business relationships between Beyeler Museum AG (hereinafter referred to as “Fondation Beyeler”) and customers for the purchase of museum admission tickets, event tickets, tickets for public tours (hereinafter referred to as “E-Tickets”), as well as for bookings of private group tours and tours for school classes.
1.2. By submitting a booking or executing a download, customers expressly agree to these General Terms and Conditions.
1.3. These General Terms and Conditions apply exclusively. Any terms and conditions of the customer that conflict with or deviate from these General Terms and Conditions will not be recognized unless Fondation Beyeler has expressly agreed to them in writing in an individual case.
1.4. In addition, the house rules of Fondation Beyeler apply to visits to exhibitions and events.
2. Conclusion of Contract
2.1. The contract is concluded when Fondation Beyeler accepts the contractual offer submitted by the customer with their order by sending an order confirmation by e-mail. This order confirmation describes the essential contents of the order. Customers must check the order confirmation for obvious spelling and calculation errors as well as for discrepancies between the order and the confirmation. Any inconsistencies must be reported to Fondation Beyeler without delay.
2.2. If customers have provided an incorrect e-mail address in the course of their order and the order confirmation cannot be delivered to them by Fondation Beyeler, the contract is concluded when Fondation Beyeler delivers the order confirmation to the customer by other means.
3. Prices
3.1. The stated prices already include the applicable statutory value-added tax.
3.2. Price fluctuations are possible. The decisive price is the one stated at the time the offer is made in accordance with clause 3.1 of these General Terms and Conditions.
4. Delivery
E-Tickets are available for download after successful booking and are additionally sent by e-mail as print@home tickets in PDF format attached to the booking confirmation. Unless otherwise indicated, the E-Ticket entitles the holder to admission to the museum at the date and time printed on it. The ticket is scanned at the entrance. Once scanned, the ticket loses its validity.
5. Terms of Payment
Online payment can be made using common payment methods such as credit card, Twint, and PostFinance.
6. Due Date and Default
6.1. The purchase price is due for payment upon conclusion of the contract.
6.2. The contractual and invoicing currency is CHF.
7. Liability
The liability of Fondation Beyeler, its representatives, and its vicarious agents is limited to intent and gross negligence. Fondation Beyeler is not liable for indirect damages or loss of profit.
For structural or organizational reasons, as well as due to force majeure (e.g., natural disasters, epidemics, wars, or official orders) or other circumstances beyond the control of Fondation Beyeler, the museum or individual parts of exhibitions may be closed, or events may be cancelled. Fondation Beyeler is also entitled to close the museum or establish special usage regulations in fulfilment of its traffic safety obligations if, in its reasonable discretion, it may assume that opening the museum would create or increase health risks for visitors, particularly if official warnings or recommendations to that effect have been issued.
In the event of a complete closure or cancellation of a tour for the aforementioned reasons, Fondation Beyeler will inform customers — insofar as possible — without delay and offer an equivalent alternative. Further claims for damages are excluded in such cases.
8. Data Protection
8.1. The data necessary for business processing will be stored in strict compliance with the applicable statutory provisions and will only be passed on to other companies for order processing purposes. All personal data will be treated confidentially. Fondation Beyeler is entitled to transmit personal data for the purpose of credit checks and credit monitoring within the framework of data exchange to companies affiliated with Fondation Beyeler.
8.2. Customers of Fondation Beyeler with a registered user account can view and edit their personal data at any time after logging into the protected area of the website. Further information on data protection can be found in Fondation Beyeler’s Privacy Policy.
9. Special Conditions for Museum Admission Tickets
9.1. Registration and Ticket Purchase
Each order requires prior registration as a registered customer or as a guest customer with Fondation Beyeler. Upon successful completion of the registration process, customers are granted access to the system by Fondation Beyeler. Fondation Beyeler may revoke this access at any time. In such a case, Fondation Beyeler is entitled to block and delete the username and corresponding password immediately.
Only museum admission tickets that are valid and purchased in accordance with the stated conditions entitle the holder to enter the museum. The booking confirmation alone does not constitute a ticket. Admission to the museum is only possible on the booked date and within the booked time slot. From the start of the booked time slot, the duration of stay in the museum is unlimited. Re-entry on the same day (after the start of the booked time slot) is possible upon consultation with museum staff at the entrance.
At the ticket control, the ticket is checked using a scanner. Without a valid ticket, admission cannot be granted, and a new ticket must be purchased at the museum ticket office.
Any discounts on E-Tickets are only valid together with the corresponding proof, which must be presented at the ticket office or entrance during the museum visit.
9.2. Cancellation
Customers are informed in the booking confirmation of the possibility to access their order and initiate a cancellation. A cancellation is only possible for the entire order; i.e., individual tickets within an order cannot be cancelled.
In the event of a cancellation, customers receive a gift voucher in the amount of the cancelled sum, which is automatically sent by e-mail. Once the cancellation process has been initiated, the corresponding e-ticket loses its validity. The gift voucher may be redeemed in a future order in the Online Ticket Shop or at the museum ticket desk. The gift voucher is valid for one year from the date of issue. Lost or stolen print@home tickets cannot be replaced.
10. Special Conditions for Public and Private Tours and School Classes
10.1. Registration and Ticket Purchase
Tickets for public and private tours and school classes can be purchased in advance in the online ticket shop or at the museum ticket office. External art mediators and tour guides are not permitted to conduct tours in the museum.
Each order requires prior registration as a registered customer or as a guest customer with Fondation Beyeler. Upon successful completion of the registration process, customers are granted access to the system by Fondation Beyeler. Fondation Beyeler may revoke this access at any time. In such a case, Fondation Beyeler is entitled to block and delete the username and corresponding password immediately.
10.2. Cancellation of Public Guided Tours
The cancellation of purchased e-tickets for public guided tours is governed by Section 9.2. Lost or stolen print@home tickets cannot be replaced.
10.3. Cancellation of Private Tours and School Classes
Cancellation of private group tours must be made in writing either by e-mail to tours@fondationbeyeler.ch or by letter to: Beyeler Museum AG, Baselstrasse 101, 4125 Riehen. The following cancellation conditions apply:
a) Cancellation up to 30 days (date of receipt) before the scheduled date: no fee.
b) Cancellation less than 30 days (date of receipt) before the scheduled date: CHF 256.– per group as a fee corresponding to the cancelled service.
c) Cancellation less than 14 days (date of receipt) before the scheduled date: CHF 500.– per group as a fee corresponding to the cancelled service.
d) Cancellation less than 5 days (date of receipt) before the scheduled date or non-appearance of the group at the agreed time: full invoice amount due.
Cancellation of a school class tour must be made in writing either by e-mail to tours@fondationbeyeler.ch or by letter to: Beyeler Museum AG, Baselstrasse 101, 4125 Riehen, at least 1 week before the scheduled visit. If cancellation occurs less than 1 week before, Fondation Beyeler reserves the right to charge a fee of CHF 100.– per group.
Cancellation is only possible for the entire tour; in the case of a reduced number of participants, the agreed fee remains payable.
No liability is assumed for cancellation of tours due to force majeure or similar circumstances. A postponement of the tour date by Fondation Beyeler of up to 30 minutes does not entitle the customer to a reduction of the fee.
11. Special Conditions for Events
11.1. Registration and Ticket Purchase
Event tickets can be purchased in advance in the online ticket shop or at the museum ticket office. If and to the extent expressly stated on Fondation Beyeler’s website for a given event, an event ticket also entitles the holder to visit Fondation Beyeler on the day of the event. The event dates listed on the website are without guarantee.
11.2. Cancellation
The cancellation of purchased event tickets is governed by Section 9.2. Lost or stolen print@home tickets cannot be replaced.
11.3. Cancellation of an Event
If an event is cancelled without replacement (this also includes the cancellation or postponement of part of a series of events or of individual performances), the event tickets will be refunded to the customers.
11.4. Special Provisions in the Event of Postponement of Events
If Fondation Beyeler decides to postpone an event, the ticket shall be valid for the rescheduled date, regardless of the reasons for the postponement. This also applies in the case of multiple postponements. It is at the sole discretion of Fondation Beyeler to decide whether tickets may be returned, refunded, or exchanged. If it is not possible for customers to attend the event on the rescheduled date, the event ticket will be refunded to the customers.
12. Final Provisions
12.1. Should any provision of these General Terms and Conditions be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. In place of the invalid or unenforceable provision, a valid and enforceable provision shall apply which most closely reflects the economic purpose of the invalid provision.
12.2. Fondation Beyeler reserves the right to amend these General Terms and Conditions at any time without stating reasons.
12.3. Swiss law shall apply, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all claims in connection with customer orders is Basel-Stadt.
